More Than A Number

That Fast Settlement Letter Can Change Your Financial Future ... And Not in the Way You Think

The adjuster called within a week. They were warm, understanding, and they had a check ready. There is a reason they moved so fast.

In the days following a serious accident, when you're in pain, dealing with a damaged car, missing work, and trying to manage the administrative chaos that follows a crash, an insurance adjuster calls. They're sympathetic. They say they want to help. They tell you the company wants to resolve this quickly so you can move on with your life. They have a number.

That number is not based on what your injuries are worth. It is based on what you're willing to accept before you understand what your injuries are worth.

Insurance companies are businesses. Their financial interest is to close claims at the lowest possible cost. A quick settlement offer — made in the first week, before you've finished treating, before your full medical record exists, before you've spoken to an attorney — accomplishes exactly that. If you accept it, you sign a release. That release closes your claim permanently. If your symptoms worsen next month, if you need surgery next year, if you're unable to work for the next six months — none of that can be revisited. The case is done.

Presuit demand

Chris Shakib and Jessica Hall walk through the full pre-suit demand process in Episode 6 of Not Another TV Lawyer. The process of crafting an effective pre-suit demand package isn't about being aggressive — it's about being complete. Insurance companies respond to documentation. A demand package that demonstrates the full scope of your medical treatment, your economic losses, and the impact on your daily life forces a different negotiation than a quick phone conversation in week one.

If the insurance company doesn't respond appropriately to a demand, filing a lawsuit becomes the leverage that brings serious negotiation. But you can't get there if you've already accepted a check and signed away your rights.
